Services

The Circuit Clerk is the Clerk of the Circuit Courts and acts as the ex-officio recorder of Greene County. The Circuit Court is made up of Domestic Relations, Civil, Criminal, and Juvenile Courts.

Administrative duties of the Circuit Clerk are to maintain a record of all proceedings of the Circuit Courts and to prep the dockets for these Courts. The Circuit Clerk issues summons, warrants, subpoenas and writs as authorized by the Circuit Court for delivery by the Greene County Sheriff or private court-appointed process server. The Circuit Clerk also maintains a file of all cases pending with the Circuit Court, as well as all the records of past court cases and their dispositions.

PLEASE NOTE: The Circuit Clerk's/Recording office will be open to the public from 8:00 a.m. to 4:00 p.m. for land recording and 4:30 p.m. for all other services.

Divisions

Domestic Relations Division

The Greene County Circuit Clerk's Office maintains the records for the Domestic Relations Division of Circuit Court. In the Domestic Relations Division, cases are initiated by the filing of a complaint or petition by the Plaintiff. A case may also be initiated by a transfer from another jurisdiction, in-state or out-of-state. Types of Domestic Relations cases are, but not limited to: Divorce, Annulment, Separate Maintenance, Custody/Visitation, Child Support, Paternity, Domestic Abuse, Contempt and Body Attachment.

Civil Division

The Greene County Circuit Clerk's Office maintains the records for the Civil Division of Circuit Court. In the Civil Division a court action is initiated by the filing of a complaint or petition by the Plaintiff. A case may also be initiated by an appeal from a lower court (i.e. small claims). Examples of the specific types of cases filed in the Civil Division are, but not limited to: Negligence, Bad Faith, Fraud, Malpractice Product Liability, Contract Issues, Foreclosures, Quiet Title, Injunction, Partition Condemnation, Replevin, Declaratory Judgement, Unlawful Detainer, Removal of Disabilities, and Name Changes.

Criminal Division

The Greene County Circuit Clerk's Office maintains the records for the Criminal Division of Circuit Court. Most court actions are initiated in criminal court by the filing of an Information by the Prosecuting Attorney. The Information is a formal accusation of crime. The Information must be accompanied by an Affidavit showing cause for the issuance of the Information and/or a bench warrant. A cause of action may also be initiated by a Grand Jury indictment or may be filed as an appeal from and inferior court (i.e. District Court).

Juvenile Division

The Greene County Circuit Clerk's office maintains the records for the Juvenile Division of the Circuit Court. Juvenile records are not open to the public. Records may only be accessed by the attorneys of record or by government agencies involved in the case. Any other access has to be issued through a Court Order signed by a Circuit Judge.In the Juvenile Division, proceedings shall be commenced by the filing of a petition with the Circuit Clerk's Office by the Prosecuting Attorney for family in need of services or delinquency or the Arkansas Department of Human Services for dependency-neglect.

Child Support Division

The Greene County Circuit Clerk's office maintains the records for the Juvenile Division of the Circuit Court. Juvenile records are not open to the public. Fees

  • Recording of any documents in the Land Records: $15 for the 1st page and $5 for each additional page.
  • Notary: $15 for the 1st page and $5 for each additional page.
  • Official Bonds: $15 for 1st page and $5 for each additional page
  • Plats: $15 for the 1st page and $5 for each additional page.
  • Surveys: $15 for the 1st page and $5 for each additional page. The State requires them to be recorded at the State level, but are not required at the Clerk's office.
  • Soldier's and Sailor's Discharges: No charge.
  • Financing Statements: Now recorded at the State level. None are accepted here.
  • Opening a new case in Circuit Court: $165 with an additional charge of $2.50 per summons.
  • Reopening an old case: $50
  • Transfer from any district or circuit court to another circuit court: $50
  • Out of State Judgement: $165
  • Non-judicial Foreclosure: $140
  • Appeal from District Court: $150
  • Certified Copy: $5
  • Receiving or sending faxes: $1 per page
  • Copies received in Office: $0.20
  • Child Support Payment Report: $0.50

How do we legally proceed with this case?

We are bound by law to not give legal advice. The public sometimes believes that they can come to our office and get fill-in-the-blank paperwork. Actually, the only court paperwork that we are required to keep for the public is the State Authorized Order of Protection paperwork. Most other paperwork is presented by an attorney. Private individuals do sometimes appear with their own paperwork, but we are not allowed by law to give them any advise on the legality of its validity. Our answer is always, "if you don't know how to get or fill out the proper paperwork, we suggest you hire an attorney." We know this is very frustrating for people that cannot afford an attorney, but neither myself nor my staff have been to law school and none of us have a license to practice law.
